Terms & Conditions

Policy - Digital services client

Effortsly Services will be hereafter be known as Effortsly.
Clients will refer to the person or entity purchasing the order from Effortsly.

Hiree(s) refers to the person or entity who is hired to perform a task from Effortsly.
(eg: Graphic designer, writer, art director, sound engineer, social media specialist, SEO specialist,  influencer and other services which are not specified within Effortsly)

1. Payment plan

Client who purchase a one off payment plan require to contact our support@effortsly.com for the job brief.

Client may also send an order form on the bottom of the homepage.

Payment plan(s) may be extended according to the job demands.

Effortsly reserve the rights to change or amend any payment plans without notice.

 

2. Termination

Termination of hiree should only be done by Effortsly. Clients are not allowed to terminate the hiree(s).
To perform a termination, Effortsly needs to be notified in writing with proof and reasoning.

Hiree(s) who are deemed unfit and were found unable to manage client’s expectations will be replaced.

 

3. Attendance / participation

In the event of the hiree(s) being unable to attend the event due to medical reasons, proof of medical leave needs to be submitted. 

Any claims of health or related to Covid-19, must be accompanied with proof of claim, such as photos of the test kit written on it with the name and date or doctor’s written letter.

 

4. Job Scope

Hiree(s) are allowed to perform the job scope within the job brief stated and agreed by the client. 

The hiree(s) is able to decline the task or work hours which is not within the job brief.

Effortsly is not responsible for any job which is performed outside of the job brief.

A dateline needs to be agreed upon by the hiree and the client

In the event of the client would like to extend the job scope, it must be notified to Effortsly in writing.

 

5. Payment 

Payment should be completed upfront.

Gifts in any form are not acceptable as a form of payment.

Effortsly will be charging up to 20% as a service charge in exchange for performing a service.

By performing any act of agreement to Effortsly, is a form of agreement to our service agreement. Including verbal agreement or agreement via text, email, any social text app and by clicking on the button on any of our page(s).

 

6. Claims

There will be no claims awarded for EPF, SOCSO or medical insurance.

Effortsly will not take responsibility in any damage or accident that occurred during the event caused by attempt or negligence by any parties.

 

7. Harassment 

Clients refrain from harassing the hiree(s) online, offline or in person. Harassment is defined as aggressive pressure or intimidation.

Hiree(s) who suffered from any form of harassment, verbal or non-verbal, if proven will be immediately investigated. 

Any unproven or fake claims under harassment will be punishable by the sum of RM5000, if the outcome of the purpose is to destruct, destroy or defame any party. This will be under the discretion of Effortsly.

 

8. Client code of conduct

The client is responsible for their partner(s) and associate(s) behavior and code of conduct.

The client should not communicate to the hiree any form of payment or exchange of contacts with the hiree(s).
If there should be extra payment awarded to the hiree(s), it should be informed to Effortsly in the form of writing.

The client should not poach or attempt to poach the hiree(s) without the permission of Effortsly.

The client should produce proof of any claims to help or support claims made by the client.

The client should not instigate, encourage, command, help or conspire with the hiree(s) to perform any illegal activities.

 

9. Effortsly code of conduct

Effortsly serves as an intermediary channel between the client and hiree(s).

Effortsly is to provide manpower services for an organization.

Effortsly is not associated with the activities of the hiree(s), client or their partner(s).

Effortsly will not bear any legal, licensing, misconduct or purchasing cost, cause by client or hiree(s) 

Effortsly will promise to see the best possible outcome of any situation of dispute or in the event of hiree(s) unable to perform up to their expectations.

 

10. Hiree(s) code of conduct

The hiree(s) is responsible for their own conduct.

The hiree(s) should adhere to the dateline agreed upon by the client.

The hiree(s) should not instigate, encourage, command, help or conspire with any party to perform any illegal activities.
The hiree(s) should not sell, publish, leak or claim information, data or work  paid or unpaid by the client.

The hiree(s) should produce proof of any claims to help or support any claims made by the hiree(s).

The hiree(s) should not attempt to destroy or defame the client or Effortsly. 

The hiree(s) should not attempt to communicate with the client with the exception of it related to the job scope.

Policy -  Event Client

Effortsly Services will be hereafter be known as Effortsly.
Clients will refer to the person or entity purchasing the order from Effortsly.
Associate will refer to the person or entity related or working together with the client.

Hiree(s) refers to the person or entity who is hired to perform a task from Effortsly.

 

1. Bookings

Bookings should be done more than 3 days before the event. In the event of it being less than 3 days, there will be a 15% last minute booking fee imposed on the total bill.

 

2. Termination

Termination of hiree should only be done by Effortsly. Clients are not allowed to terminate the hiree(s).
To perform a termination, Effortsly needs to be notified in writing with proof and reasoning.

 

3. Attendance

In the event of the hiree(s) being unable to attend the event due to medical reasons, a replacement will be given. In the event of the replacement being unable to accept the job, a new job will be posted and it is up to the availability of the hire.

 

4. Job Scope

Hiree(s) are allowed to perform the job scope within the job brief stated and agreed by the client. 

The hiree(s) is able to decline the task or work hours which is not within the job brief.

Effortsly is not responsible for any job which is performed outside of the job brief.

In the event of the client would like to extend the job scope, it must be notified to Effortsly in writing.

Hiree(s) who work which exceeds 4 hours needs to have a 30 min break each consecutive of 4 hours.

 

5. Payment 

Payment should be made 50% upfront, 3 days before the event for an amount exceeding USD100. 

Full payment should be made for any amount less than USD100. 

The remaining payment should be completed not more than 14 days after the event. Payment deadlines including weekends and public holidays.

Gifts in any form are not acceptable as a form of payment.

By performing any act of payment to Effortsly, is a form of agreement to our service agreement.

 

6. Refund

There will be no refund given for the first 50% of the deposit if there should be any cancellation. Refunds are up to Effortsly discretion. Refunds will be done within 14 days to 30 days of the date of the agreed refund amount.

 

7. Harassment 

Sexual harassment is defined as any behaviour of a sexual nature that affects the dignity of women and men, which is considered as unwanted and unacceptable.

Harassment is defined as aggressive pressure or intimidation.

Hiree(s) who suffered from any form of harassment, verbal or non-verbal, if proven will be immediately transported out of the situation without replacement. The cost of the transport will be borned by the client. Any form of harassment as above will be investigated and will be punishable under the relevant penal code.

 

8. Client code of conduct

The client is responsible for their partner(s) and associate(s) behavior and code of conduct.

The client should not communicate to the hiree any form of payment or exchange of contacts with the hiree(s).
If there should be extra payment awarded to the hiree(s), it should be informed to Effortsly in the form of writing.

The client is fully responsible for the hiree(s) under their care which includes any accidents by act of god or act of man.

The client should not poach or attempt to poach the hiree(s) without the permission of Effortsly.

The client should not instigate, encourage, command, help or conspire with the hiree(s) to perform any illegal activities.

 

9. Effortsly code of conduct

Policy - Event crew members / promoter / photographer / videographer

Effortsly Services will be hereafter be known as Effortsly.
Clients will refer to the person or entity purchasing the order from Effortsly.
Associate will refer to the person or entity related or working together with the client.

Hiree(s) refers to the person or entity who is hired to perform a task from Effortsly.

 

1. Bookings

Hiree(s) who are booked for the event are not allowed to cancel unless accompanied with grounds of medical health.

Hiree(s) is responsible to find a replacement to replace them if unable to attend the event or payment in lieu of the job.

 

2. Termination

Termination of hiree should only be done by Effortsly. Clients are not allowed to terminate the hiree(s).
To perform a termination, Effortsly needs to be notified in writing with proof and reasoning.

Hiree(s) who are deemed unfit and were found unable to manage client’s expectations will be terminated.

In the event of the hiree(s) being unable to attend the event due to medical reasons, proof of medical leave needs to be submitted.

Bonuses will be awarded up to Effortsly discretion after the event or occasion.

Gifts in any form are not acceptable as a form of payment.

Effortsly will be charging up to 30% as a service charge.

By performing any act of agreement to Effortsly, is a form of agreement to our service agreement. Such as verbal agreement or agreement via text or any social app.

 

6. Claims

There will be no claims awarded for transport, medical or attire will be given.

Effortsly will not take responsibility in any damage or accident that occurred during the event caused by attempt or negligence by any parties.

 

7. Harassment

The client should not poach or attempt to poach the hiree(s) without the permission of Effortsly.

The client should not instigate, encourage, command, help or conspire with the hiree(s) to perform any illegal activities.

The hiree(s) should not attempt to communicate with the client with the exception of it related to the job scope.
